Can I get EI if I quit my job?
If you quit your job, you will probably not qualify for EI unless you had "
just cause". Just cause means you had no other reasonable choice but to quit.
Examples of situations that could be considered "just cause" include:
- you were sexually harassed
- you were harassed or discriminated against because of race, colour, sex (which includes discrimination because of pregnancy or childbirth), national or ethnic origin, religion, sexual orientation, marital status, family status, disability, age, or your conviction for a crime if you have been pardoned
- your supervisor was unfair or hostile to you for no good reason
- you were expected to work in dangerous conditions
- your wages were significantly reduced, or there were major changes to your duties
- your employer pressured you to leave your job
- you were not paid for overtime worked, or were forced to work excessive overtime
- you were discriminated against because you belonged to a union
- your employer was doing something illegal
Other reasons considered "just causes" for quitting your job include circumstances where you needed to move away in order to accompany your spouse, common-law partner (which includes same-sex partner), or dependent. If you were reasonably sure you would start another job right away or you had to care for your child or other close family member are also considered "just causes" for quitting a job.
NOTE: None of the examples listed will automatically be considered "just cause" to quit. And there could be other acceptable reasons for leaving your job. Even if you were fired, you may be eligible for EI benefits. If possible, try to obtain legal advice before quitting your job. If you are turned down for EI because you quit your job or were fired, you can appeal this decision.
