接通的人告訴我,既然是Crown Consult 的人要求我女兒回去做 Witness 那麼檢方應該會負責我們的旅費, 要我直接找檢方詢問
對方說他們的 Victim Travel Assistance 沒有Cover 我們的旅遊費用( Flight Ticket)
要我打電話 問Victim Safety Unit 1-877-3158822,但是 他強調他也不確定 這是否適用於我們的狀況
我信件裡,也把我們的檔案編號寫上去
電話中也跟對方詳述了 事情發生的經過,不過他聽到 Crown Consult 要我們去當Witness 他就說他的機構 沒有辦法幫助到我們

ps 電話裡 我問他 為什麼我打1-800-563-0808 的電話不能接通,他說那個電話是 BC省或者加拿大國內打 才有效的,我從國外打,沒用

我想檢方應該也是考量這個層面
因為這個犯人躲藏的是一間非常非常火紅的港式飲茶餐廳的女廁所,裝潢很棒,車水馬龍,人來人往,川流不斷,
我女兒們沒有受到身體上的傷害,可是心理上受了很大的驚嚇
所幸當時有家人在旁,且到場的員警給予我女兒們很大的支持和鼓勵
當時候,她可是慘白著臉 發抖著身體 跑出來,而且 女廁跟後面逃生門很近,如果她在廁所以面反抗,搞不好被抱走,我們都不知道
(因為餐廳太高級,廁所在櫃台左邊後方,從廁所出來就是逃生樓梯
我們是在櫃檯的右邊樓梯出入口,一般客人都在那裏等待著帶位,
我們在等著去停車場取車接我們的家人,所以我們才讓她們倆姊妹自己去上廁所,而沒有進去陪她們)

事情發生時,我們請餐廳給警察監視器畫面
他們竟然告訴我們 餐廳沒有監視器,沒有監視畫面,而且我們圈住犯人時,他們也不願意打電話報警
直到我們一直再三堅持,請求,經理才不情願地打了電話

警方來了以後,當場帶補這個犯人(衣著非常好,穿靴子左耳朵有類似鑽石耳環) 總而言之,光看衣著 ,不知道他會是躲在廁所的變態
這嫌犯肯定抓緊 中餐廳沒有監視器,(天花板上都看不到,只看到水晶燈) 而且生意好,他就穿得光鮮亮麗
趁空檔跑去女廁躲,估量著我女兒應該會嚇跑,
他彎腰,露出兩個眼睛,從門下面看了我女兒如廁10多秒,
我女兒是顫抖著出來的

這樣想起來,這是嫌犯是很聰明的計畫這件事情,只是沒想到遇到鐵板,可能當局也怕這樣的人 繼續再犯
如果更多人受害 該怎麼辦?
連我們大人都受到不小的驚嚇,更何況孩子?

總之 勿以惡小,而為之, 還好 現在的時代 已經不是人家說的 [被人家看一下 有甚麼關係?]

有一个关键问题：你是否收到了subpoena 文件,即上面印有你孩子的名字,家长的名字 内容是关于请求你孩子上庭作证,签署者是来自法庭的一封文件？

你目前的困扰基本都取决于这封文件,收到与否决定着你目前是处于哪两种状态：
1.和检察官们协商准备出庭事项
2.被传唤作证（还是觉得不太可能,难度太大）

说实话,victim Link给出的这种模棱两可的答案极其不负责任,处于什么都没准备好的第二种情况下就让你们跨国出庭for what？但目前crown还没和你们取得直接联系,不好再加以评判,虽说之前有提crown的权限最大极有可能直接帮你们拿到所有该给的补贴,但不代表victim link可以一问三不知或是推三阻四,他们本身就是负责这一方面的。

我就直说了吧,他们懒,以为你不懂。
解决办法要么等crown联系你时你再问,要么你按照之前说的,请求个助理协助你处理。请务必记得,财务方面的补贴要在一年内申请才有效。

后话：假如crown 和victim safety unit 都表示爱莫能助, 那就量力而为之。正因为应该主动维护正义的人却无所作为,才让如今人渣肆虐枪林弹雨,至于老百姓,又能做什么呢。坏人不需要法律,随意为非作歹；而好人却需要遵守法律,一次又一次靠自己去搜集证据…
另外,加拿大也不是Hague Conventions的签署成员国,假如有人硬是弄成传唤,以此告知不来就会对自身产生不好的后果,理应无效。

符合常理的处理办法
第一种：只需要你填文件,几个月后出了结果告知你人渣的宣判结果。
第二种：合理帮你办理财务补贴,请你们出庭作证

不符合常理的处理办法：全部自费,请你们出庭。

各位大大,我目前還沒有收到正式的傳喚令,今天我終於接到檢察官的來信,
來信如下:

I have spoken to the lawyer for the accused and he anticipates the matter can be resolved without a trial. However, he has not been able to reach his client. He is waiting to hear from his client to get instructions.

If you require approval from the school for your daughter to be absent perhaps it would make sense at this point to make a request given that I do not have confirmation at this point that the matter will be resolved.

If the lawyer for Mr. Drake cannot reach his client, there is a court appearance on September 5, 2018. It is possible he will show up on that day and we can confirm whether the matter will be for plea. You are not required to be here on September 5. That is an appearance only for the lawyers and the accused.

在first appearance环节,根据人渣的选择认罪与否会产生一下两种境况

不认罪：进入preliminary inquiry环节,证据充足就会有stand trial,证据不充足则 charge dismiss.假如dismiss了也算是“solved without a trial”

目前为止他并没有被定罪，还没到那一步,还得看人渣那天如何选择。


关于 preliminary inquiry/ hearing：
这是一个重在列举嫌疑人罪行的环节,并且只有在被告被指控有可起诉罪行的时候才会发生。

我会更新一些我能想到的东西,夜深了思维比较缓慢,暂时就这些。

At beginning of thing happened, my daughter Sandy was shaking her whole body and very frightened.
Thanks God that she didn’t irritate the man. and tried to get out as soon as possible.

This man was in the Washroom more than 1 and half hour, because my little daughter Elaine recognized immediately the man’s boots. She went to the Washroom with me first when we were just arriving the Chinese's restaurant.
I review all the photos which we took there, I believe there was no CCTV or camera to catch the real time when was the man enter the washroom
There are a lot of big and beautiful Chinese restaurant in Vancouver, we never thought there was a person can use this advantage of resturant to cover his plan.
This case affected a lot to my children also my family and my family in Vancouver, they don’t feel safe to go to eat at that restaurant and after all, girls are afraid to go washroom alone, and we spend time to be their side to talk with them, and try to let them feel be support. But I am not sure if we are doing 100% great, I will try my best.

I encourage Sandy and Elaine that they were doing very well to tell police about the man was doing a bad things and may avoid any furthermore harm to other people.

• A little spark may kindle a great fire. This is very big lesson to us to not to be so confidence when we travel.

Please keep advise us the new progress of this case, truly hope that we can give any help to avoid any harm may happen in the future.

不清楚这系统能不能查到有用的信息,但日程信息应该是能查的到的
你应该还有得知agency的全称,在下拉选项框中找到后,把agency file No.连同数字带符号一起复制进去,下方的 your file No.不用去管它。再者,直接在右边选项卡选择姓名检索或file No.检索尝试也是可以的,只是需要更多信息来信中可能未有提及,比如在哪个法庭审理。

警方不会做控方，跟你联系的律师是代表谁的？一般来说警察审理以后提交给prosecutor(检察官)进行控告。检察官本身需要上庭的，怎么还有其他律师跟你联系？
在你女儿testify的同时，辩护人和控方都会对你女儿提问和质疑，有些问题可能challenging. 这一点你要知道，并且做好心理准备。
至于语言和费用的方面，你应该跟法院或者这个跟你联系的律师联系。
要出庭几次不好说，有可能就一次，也有可能后来双方发现有疑点，需要你再次出庭也是有可能的，这就看案件的复杂性和控辩双方的水平了。

加拿大政府是很看重孩子的。赞同你的观点，警方或许会对楼主女儿提些问题，小孩子可能会有第二重压力，要有思想准备。

昨日收到檢察官的回信,明天會宣判,看來那個嫌犯有初步認罪,如果認罪也被宣判,我們就不用去出庭作證

Thank you for your e-mail. The trial dates in October were cancelled. The accused had a miscommunication with his counsel and, as a result, a bench warrant issued and the trial dates were cancelled. The accused has since appeared in court and indicated to his lawyer that he will plead guilty.


I will know more about what is happening with the file at the next court appearance on September 20, 2018.
