今天看了Honorable Mr. Kenney在CBC的联线采访。他的关于breach of contract的辩解让我感到震惊和困惑。难道我们的康部长没有读过law school? 立刻跑到CIC的官网去求证，结果证实了我的看法。加上看了最新的一期《非诚勿扰》，节目精彩的对白让我彻底睡意全无，索性把这个帖子发上来，逗个乐子。

Honorable Mr. Kenny 的这段argue，把它整理了出来如下，

震惊和产生疑问的原因如下：


1、事实合同和形式合同

91SAP的申请人和CIC没有签署形式（literally）合同，但是存在一个由cic提出的关于申请人的资格和申请程序的terms，这些terms被申请人按照要求的程序通过递交文件（SAP申请简表）来进行了接受表示。CIC为此提出了提供审理服务的对价要求，而申请人支付了对价（申请费），并收到了来自CIC的审理承诺。这个不是要约条件齐备的事实合同是什么？


2、部长说we have the priority to consider it according to our own criteria. 进入了履约的阶段后，CIC再大也是和申请人具有平等的契约地位，这个priority从何而来？


其次，进入履约阶段，任何的criteria，都是共同的，哪里还与你的own criteria？ 如果你要改变这个，需要征得另外一方的同意。


我相信这才是让他笑得那么cute的原因，

总结：
此段argue，可以作为CIC有清楚的intention去借立法的更改，去侵犯合同另一方的申请人的权利。

呵呵，话糙理不糙，但是因为发生在自己身上，所以我们要力争，先不管结果啦

刚看了视频，我看康部长麻烦大了。整个回答没有任何新意。就会翻来覆去的说这么做如何如何必要，如何如何对加拿大好这类的陈词滥调。而对主持人就一刀切是否公平的问题顾左右而言其它。

明显的他现在的压力比1个多月前刚公布一刀切的时候大多了。而且现在主流媒体也介入，明显扩大了影响。整个事件还在持续发酵中。
