路透社分析移民局的数据却发现，自1990年以来，共有13719名移民投资者申请EB-5签证，其中4489人被拒，原因包括不能向政府证明资金来源合法等，另有848人申请仍在审理中。而在8382名允许进入项目获得有条件绿卡的投资者中，只有5748人理论上可以申请正式绿卡。20年间，他们中只有3127人得到正式绿卡，另外2621人要么申请被拒要么官司缠身，或是放弃投资返回家乡。也就是说，仅有54%进入项目的移民最终获得正式绿卡。

路透社这篇文章的水平很低。查一查EB-5历史就会发现它分几个阶段。出问题最多的是1997年前，1997到2003 由于有些金融机构把EB-5做成好像18或19万就可以办理的，最初被通过，后来都被移民局否决了。这段时间的人很惨。（最近发现有中国中介公司伙同加州华人又在玩25万美元移民美国的过时游戏，有些投资者还愿意相信，习惯性投机取巧心理作怪。）但是从2003年后开始增加，2008年后增长迅猛。把每年的数量列出来会看到审批和批复趋势的。
从1990年开始，到1992年产生区域中心计划，到今天，上网查查每年的申请和批复数据。
路透社文章没有说假话，但是分析问题的时候太像文科生，方法论非常不科学。如果说把一个问题看完整了需要考察4个变量，路透的文章就只考察2个，仓促得到一个他们预设的结果。他们的说法一半以上方向是对的。但是文章写的非常偏激，片面。而且对事情看法缺乏深度。
不要以为新闻媒体是客观的。路透社的文章是预先定调然后再去根据自己最终目的去取样的。这点让我很不齿。这些方面更倾向自由派的纽约时报或基督教箴言报比路透强。
美国移民局思路现在是，严格审批I-526，提高I-829通过率，来提高整个项目的质量。使其能长久为美国带来外来资金，促进就业。注意到外来资金对于美国政客而言，没有一分钱占用了联邦和地区，甚至企业及纳税人的一分钱，何乐而不为呢！移民局希望EB-5项目能长期稳定地为美国创造就业。

What is most compelling at the I-526 stage is to have a solid business plan that transparently describes how the requisite jobs are going to be created within that timeframe. Also, in terms of specific position or job to be created, the requirement is for the jobs to be permanent full-time (35 hours per week minimum), and there is no preference given to a specific position over another.
A job-sharing arrangement whereby two or more qualifying employees share a full-time position will count as full-time employment provided the hourly requirement per week is met. This definition does not include combinations of part-time positions or full-time equivalents even if, when combined, the positions meet the hourly requirement per week. The position must be permanent, full-time and constant. The two qualified employees sharing the job must be permanent and share the associated benefits normally related to any permanent, full-time position, including payment of both workman’s compensation and unemployment premiums for the position by the employer.

Sustaining the Capital Investment
USCIS stated that the EB-5 investor must sustain the capital investment throughout the two year period of conditional permanent residence. An EB-5 investor may sell the investment after the removal of the conditional status. In cases where the investment was sustained for the required two years of conditional residency, the sole act of selling the investment prior to the adjudication of the investor’s I-829 is not a basis for a denial of the I-829. However, in many cases with this type of fact pattern, the required 10 jobs may not have been created or the record may not show that the requisite jobs will be created in a reasonable amount of time, which may result in a denial of the I-829 petition. USCIS also reminded participants that any pre-arrangement for the sale of the investment must be based upon the fair market value of the investment at the time it is sold.
