We received the decision today in the Federal Court litigation challenging the termination of the Federal Skilled Worker applications. Justice Rennie of the Federal Court dismissed the arguments to continue the processing of the FSW applications. We have attached to this email the decision and reasons.

The judge certified 3 questions in this case. This means that the Court has left the option for us to appeal the decision. Mr. Waldman advises that there are grounds to appeal based on the finding by the Court that the
re is no individualized assessment owed upon termination of the applications by section 87.4.

If you would like to appeal this decision, please send an email to with the following information: (1) write "YES" or "NO" to proceeding with the appeal; (2) give the full name of the person who was added to the litigation; (3) give the applicant's CIC file number. If we do not hear from you by Wednesday April 24th, we will assume that you are not interested in proceeding with the appeal. Please note that we have 15 days from today to fil

嗯，我也收到了，可以上诉。回想起来，在后来法官要求提交书面辩论时，关于人权条款是否适用国外申请人，确实是挖好了准备给我们的一个大坑，预示着不利消息。
我要求上诉，坚决抗争，为自己也为了大家，争取正义！
我们要求赔偿！
法官说什么申请人是自由申请freely，移民没有产生财产类似的收益权，所以不能要求补偿， 而且移民本身就是不确定的,是Chance!而且国会可以通过法律取消补偿。但是我们申请人付出了机会成本，这笔钱本来可以投资的,或者可以用来买保险。毫无疑问,我们这些自由freely投资虽然得到回报和保障的机会是不确定,但也不可以随意侵犯。法律必须公正，不能随意玩弄弱者，剥夺基本的经济权利。毫无疑问，我们申请人按要求考雅思，体检、公证等都花费不菲，这些付出的成本不是财产也是损失，凭什么剥夺也不加补偿,那加拿大可以全球行骗了? 然后国会通过法律赖皮一下,法官混淆视听帮着掩护一下就万事大吉了!?
