Federal Court upholds law allowing federal government to toss old immigration applications



Last month, Immigration Minister Jason Kenney released new figures that suggest the backlog in the federal skilled worker stream now stands at just 91,403 with turnaround times of about a year. By 2015, the backlog is expected to stand at 10,221 and turnaround times for permanent residency should be about six months



OTTAWA — The federal government was acting well within its rights when it decided last spring to toss the immigration applications of some 280,000 skilled workers and their families, the Federal Court ruled Thursday.

The budget 2012 initiative aimed at drastically reducing a massive backlog of old applications was challenged by a group of about 1,400 would-be immigrants who felt the move violated their rights under the Charter and Bill of Rights.

The court, however, ultimately sided with the government.

“The applicants have waited in the queue for many years only to find the entrance door closed. They see the termination of their hope for a new life in Canada to be an unfair, arbitrary and unnecessary measure,” Justice Donald Rennie concluded.

“However, section 87.4 (of the budget bill) is valid legislation, compliant with the rule of law, the Bill of Rights and the Charter.”

Rennie added the applications were “terminated by operation of law” and that the court did not have the power to order the government to change its legislation.

As per the rules of immigration law, he did, however, certify three questions related to whether the legislation is constitutional and whether applicants should have been notified in advance and been given a chance to rebut the plan.

The questions could effectively form the basis of an appeal, something Toronto lawyer Lorne Waldman said he will recommend to his clients. If they choose to pursue the case, he’ll have 15 days to file the appeal.

“Personally, I’m disappointed but it’s not an easy task to try to convince a judge to strike down legislation,” he said in an interview shortly after the ruling was made public.

“What’s more difficult for me is to tell all these clients who retained me … because, you know, these are people who basically followed all the rules and acted perfectly legally and in compliance with what the government of Canada told them.”

Noting the government line has been to slam so-called “queue-jumpers” who claim asylum in an attempt to fast-track immigration, Waldman said others like his clients played by the rules, “waited patiently for years” and spent thousands of dollars getting the necessary language training, medical tests and police checks only to have their “hopes dashed” in the end when those rules were suddenly changed.

“My heart goes out to the people who in my view are victims of this callous legislation,” he said.

The government, meanwhile, welcomed the ruling. Alexis Pavlich, a spokeswoman for Immigration Minister Jason Kenney, said the decision to refund $130 million in application fees and destroy the files of all those who applied to come to Canada as skilled workers prior to Feb. 27, 2008 was critical as the backlog had grown out of control.

“As a result of the actions taken by our government to deal with the massive backlogs and unacceptably long wait times we inherited, new (federal skilled worker) applications will be processed in less than a year,” she said. “We would not be able to remain competitive and attract the skilled immigrants Canada needs if we were to allow backlogs and wait times to grow again.”

According to Citizenship and Immigration, as of March 22, the government had returned fees for about 5,400 applications.

Last month, Kenney released new figures that suggest the backlog in the federal skilled worker stream now stands at just 91,403 with turnaround times of about a year. By 2015, the backlog is expected to stand at 10,221 and turnaround times for permanent residency should be about six months.

As it moves towards an immigration system that favours youth, language proficiency and specific skill sets, the government has also argued many in the queue have skills that are considered no longer relevant.

Last summer, the government issued a moratorium on new skilled worker applications pending an overhaul of the program. The program is scheduled to reopen on May 4 when applicants will be assessed according to the new criteria and will be required to have any educational credentials vetted to ensure they won’t get stuck driving taxis because their physician training isn’t up to par.

On Thursday, the government also unveiled a list of 24 eligible occupations which means only engineers, geoscientists, land surveyors, financial analysts, computer programmers, health inspectors, audiologists, physiotherapists, occupational therapists and medical technicians will be able to apply to come to Canada as skilled workers.

The government also capped the number of new applications it will accept this year at 5,000. The new rules, however, don’t apply to those who already have an offer of employment or are applying to the program as doctoral students studying at Canadian universities.

The government is poised to accept about 55,000 newcomers under the federal skilled worker program this year
