“Had it been longer, we probably wouldn’t be here today,” Luka Magnotta’s defence lawyer told the jury on the opening day of the 32-year-old’s first-degree murder trial.
Luc Leclair told the eight-woman, six-man jury that his client admits to the five counts against him, including the murder of Concordia University student Jun Lin, but will set out to show that his mental state prevented him from fully grasping what he was doing.
Crown prosecutor Louis Bouthillier, on the other hand, told the jury that the evidence they will hear over the next three or four weeks will show that the murder was planned up to six months in advance and that it was deliberate. He said an email a British reporter received makes it clear that Magnotta had planned to kill a human being and make a movie of it.
“You will see the so-called murder video,” Bouthillier told jurors. “Evidence will show it was posted by Magnotta on a website.”

He also revealed the shocking revelation that the first 53 seconds of the video, shot the week before, shows another man who had been drugged and tied to Magnotta’s bed.
“The video shows Lin Jun in the same position,” Bouthillier said.
That video will be shown during the third week of the trial and Bouthillier told jurors they would be forewarned, given the upsetting and gruesome nature of the material.
The charges against Magnotta are first-degree murder; committing an indignity to a body; publishing obscene material; criminally harassing Prime Minister Stephen Harper and other members of Parliament; and mailing obscene and indecent material.
The trial is expected to last between six and eight weeks.
