The legal term is negligence, not omission, and you have to prove its gross or not.

But before you get to the torts analysis, you better check whether there is any contractual claim, which often cases are better off than torts. Well, as you said, without the facts, how do you know if this is a private school or public school.

BTW, common law also has statutes, that is why MOI enjoyed reading the bill.

if you would like to bring an action against the school authority,you have 4 steps to go.
1 duty of care established the school authority owed
2 whether the school authority breached the objective standard of duty, further facts required
3 causation and remoteness further facts required
4 whether the claimant constituted contributory negligence or not. further facts required

in short you must provide more detailed information with respect to this issue.

加拿大普通法法院往往引用其他普通法法院(包括美国，英国，澳大利亚和新西兰)的法律原则。

魁北克法院往往采用"法国民法典"的法律原则。

加拿大宪法并没有完全禁止立法机关通过有回溯力的法律。
