Chinese Investors May To Be Cut Off from EB-5 Regional Centers?

Charles Oppenheim, the Chief of Visa Controls and Reporting Division at the U.S. Department odf State, was a guest of honor at the recent IIUSA conference in Washington D.C. At the conference, Mr. Oppenheim informed the audience of EB-5 professionals and operators that if the current growth trajectory continues for Chinese investors investing in the EB-5 regional center program, he anticipates that the issuance of Green Cards to Chinese investors will be suspended in the second half of 2013.
This suspension would be a temporary measure, Mr. Oppenheim said, and his depratment would watch to see if other countries take up the demand slack. If they do not, the department indicated they would look at opening up again to Chinese investors.

It is anticipated that this measure, should it come to pass, would be a temporary one only, however, the impacts could be far-reaching, echoing the Canadian Federal Investor Program, where Chinese Investors previously lined up and waited, applications ready, for the program to open up each year, when the backlog of investors submitted their investments and quickly met the quota, closing the program for the year relatively quickly after it opened.
What Does This Mean?
First it should be noted that if this cut off should occur Chinese investors may still be able to submit I-526 applications and even be approved, but their Green Cards may not be issued until the program opens up to them again. Another big implication is that if a given EB-5 regional center is focused on Chinese investors, they should start planning on targeting other countries as a backup.
This is an important issue and should be watched carefully and considered by anyone who is currently putting together plans for an EB-5 regional center application.
