我给Tim和Lorne每人发了一封email,Tim在10分钟之内回了, Lorne还没有回。
Tim的回信:
I do not intend to organize a class-action lawsuit but I expect that someone else will. If so, I'll just tag along.
The problems with a class-action lawsuit are:
1. everyone in the class, not just the litigants, gain the same benefit;
2. because the class is too large -- 280,000 -- CIC can't process all the files within a year.
Thus, it would only be a restoration of the status quo; i.e., indefinite warehousing.
3. as everyone gets the same benefit, those who pay to join have wasted their money, and I don't want to tell people to pay me when those who do not get the same benefit.
Finally, until Parliament cancels the old files, there will not be a class-action lawsuit. In the meantime, I hope that our litigation will have had a decision. (After the Court formally sets the date, I will file a motion, asking the Court to forbid CIC from closing any of the litigants files so long as our litigation is before the Court.)

28万人都会获益,不参加起诉和参加起诉的效果一样。

去年参加起诉的人,也许会在CIC作废之前法庭给出结果。兴讼的诉求是什么?提起诉讼的依据又是什么?
如果CIC作废在前,法庭开庭在后,就没戏了。在Tim的世界里,因果关系到底是怎样的?
但是Tim近期会向法庭发起提议,要求禁止CIC作废去年参加起诉那一批人的案子。提起“例外”(或者"豁免”)的法律依据是什么? 存在提起“例外”(或者"豁免”)的法理基础吗?

但得到的利益也大,比如影响力大,CIC给的赔偿会分的多(不确定),集体诉讼对律师似乎有一定风险。TIM当然是清楚集体诉讼的,但TIM寻求的是一年内使起诉人结案,并且集体诉讼要等立法出来后才能发起。虽然集体诉讼会使不参加的人也受益,但总要人参与和发起,这就要觉悟了,不能有猴子摘包米心态。
