一个律师对这个问题的解答：

关于这个问题，我们做一下说明。

美国移民历来有一个名额问题，因为很多移民类别都供不应求。全世界想来美国的人太多。对于投资移民来说，目前每年一共有1万个名额。这个1万的算法不是指1万个投资人，而是包括投资人和他们的家属。如果我们按照一个家庭夫妇两个只有一个小孩移民来计算，这10000个名额也就只能接受3333个投资移民的申请。而根据美国投资移民的最新统计数据。这个额度很有可能在2013财政年度内突破。原因如下。2011年共收到3800份申请，2012年截至到9月30日，共收到4100份申请，目前已经批准3000个。按照这个数字估计，2013年财政年度从2012年10月1日开始，估计到2013年6月30日的9个月里，526批准的数量将突破3333个，到那时候，就会出现名额短缺的问题。美国移民局处理名额短缺的方法一般就两种，一是要求国会增加名额，二是让申请人按照递交526的时间排队。假定国会不增加名额的话，那就只有排队这一种解决方案了。

关于中国申请人的配额问题是基于美国追求多元化的移民政策。即不想让某一个移民类别完全只给来自一个国家或种族的人群所使用。所以当投资移民名额紧张时，移民局可能会为其他国家的投资移民申请人每年预留一些名额，这将减少中国投资移民申请的名额。如果这些名额别的国家的人用不完，那么可能再转给中国人用，避免名额浪费。

对于中国人来说，如果想避免等名额的尴尬，目前唯一能做的就是尽早提出526申请，就算是到2013年下半年开始排队，也可以排在前面，等2014年的名额在2013年10月1日开始使用的时候，一下子就可以拿到名额了。

换句话说，投资移民美国，特别是投资区域中心的项目，要做好持久战的准备。 区域中心项目的526批准要12－18个月，赶上绿卡排期又要12－24个。

请问3333是526的数量，还是移民签证的数量？如果是526的数量，那现在已经拿到526的同学是不是就不受影响了？

3000个是526的数量。今年年底前能拿到526批准的投资人差不多不会受排期的影响。明年得到526批准的投资人很有可能受签证排期的影响。

虽然3000个526名额在明年3－5月不会用完，移民局会限定中国投资人的签证名额，估计明年5－8月不会给中国人面试签证。也许在明年9月，移民局财政年度9／30截止前，会发放剩余EB-5名额给中国的投资人，或者转给其他国家的EB-2 或 EB-3排期的绿卡申请人。

This would be the first time a cut-off date has been established in this category, which is why readers are being provided with the maximum amount of advance notice regarding the possibility.

The above projections for the Family and Employment categories are for what could happen during each of the next few months based on current applicant demand patterns. The determination of the actual monthly cut-off dates is subject to fluctuations in applicant demand and a number of other variables which can change at any time. Those categories with a “Current” projection will remain so for the foreseeable future, with the possible exception of the China Employment Fifth preference category mentioned above.

IIUSA has published the EB-5 processing statistics through Q42012 recently released by USCIS to AILA. The report shows that USCIS has been particularly busy with I-526 petitions, of which it received 6,041 and processed an impressive 4,634 in FY2012 (ending 9/30/2012). This year saw a record number of I-526 approvals and a record number of I-924 denials. The approval percentages for investor petitions fell slightly from FY2011, down to 79% for I-526 and 92% for I-829, while approvals for Regional Center applications and amendments tanked to an average 36%.

2013年4月1号。

2012财政年已经批准了3677 I-526申请, 2012年一月到九月批准了2498个I-526申请。 就象我以前说的，今年12月底没有I-526申请批准的，估计是没有2013年的绿卡名额了。区域中心的项目的投资人可能即使批准了，也未必有名额。

移民局审批I-526申请，也按投资的项目分区域中心和非区域中心，50万和100万分类。

如果要排期了，是按照发广的日子呢？还是说想NVC递交申请开始？我觉得应该是NVC递交申请开始算吧，那么如果4月1日开始排期，只要在3月31日前递交485申请或者NVC申请就可以了，是这个意思么？那么倒推上去，只要526在2月底前批准，基本不用担心；按照526审核8个月算，在2012年6月前递交526申请的基本也没问题，7月开始WAC的就要看运气了。我这数学做得对么？

我想会比较复杂。本来是按priority date，交件的时间。

但EB-5有分4个类别，C5, T5, I5 和 R5。这4个类别批准的数度不一样。交件早的I5区域中心的50万投资类，批准速度最慢。先交件的申请，priority date靠前，但I-526可能一年多还没有批准。 后交件的直投项目和100万的区域中心项目的申请，批准比较快，4－6个月就批准了。这些申请虽然priority date比较晚，可能会先给绿卡。

可能EB-5会有不同的排期方法，按I-526批准时间，notice date. 所以是看项目能否快速批准了。

2. Section 201 of the Immigration and Nationality Act (INA) sets an annual minimum family-sponsored preference limit of 226,000. The worldwide level for annual employment-based preference immigrants is at least 140,000. Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620. The dependent area limit is set at 2%, or 7,320.

配额的统计是区分普通Eb-5、TEA地区的EB-5，以及区域中心的EB-5的

如果现行法律不改变的话（没准到时候就改了），每年每个国家的Employment Base移民配额上限是25620.

排期排的应该是NVC申请和485吧？还是说526就开始排期？ 说实话要是526开始排期，事情反倒简单了，啥时候526批准就可以申请绿卡，那么划款时间也没冲突了，要不526早早过了，苦苦等签证，钱又进项目了，这才不好办啊

EB-5的配额只涉及中国投资人。

2013年4月份以后，需不需要给中国人建立或者设定配额呢？还不一定呢。

首先EB-5投资是为了创造就业，繁荣经济，带动本地投资，可谓有百利而无一害，本身就应该予以支持和鼓励，开放投资，谁来都可以，不管你是哪个国家的。如果我是decision maker, 我不会去限制到美国来投资！（这个与国家安全不沾边啊）

在全球经济形势下，其他各国投资人的投资能力和抗风险能力，投资者的人数，有几个能与中国投资者抗衡的？

依据priority date来排期未必适合区域中心项目的EB-5申请。一个原因是I-526的批准率在下降，今年会降低到75％。 就是1／4的priority date 不会被批准。 另外是区域中心的项目申请批准时间长，需要一年时间才可以批准出来。 除非是要给区域中心的项目一年的排期，等等下一年度的绿卡名额。
