我在一家做了两个多月full time后辞职,他们没有在最后一次工资给Vacation Pay. 我写电子邮件告诉他们劳动法有规定, 没过多就就收到支票了.

我老公打工时也是,打工那个中介,根本不提的,打电话去要求知道你懂的,就立马给了。我们没等到辞职,每次和正常工资一起给的。因为是临时工作,也经常不是一周40小时能做满的。按比例给的。

what is vocation pay ? every month u will vocation pay ? i did part time in vanvouver chevoron station then fish shop . dint see vocation pay? what is it ? someone can explain more ? thanks . when u have vocation . then u get vocation pay ? or even if u dont take vocation . u still have vocation pay??

Everybody has the right to have vacation with regular pay while he/she is working for somebody. That's the law. If you don't take the vacation, then the employer has to pay you for giving up the vacation. The minimum vacation pay rate is 4% of your regular pay.

这个解释不对. 我查询了政府网站, 不是说你放弃休假才能得到Vacation Pay, 而是说你有带薪休假的权利, 即: 当你为老板工作满一年之后, 你有权利在第二年任何时候休两个星期, 同时老板必须支付你Vacation Pay, 钱数是你第一年收入的4%.

其实这个问题这么简单,为什么会胡搞蛮缠呢?

要么拿年薪+4%的现金,要么拿年薪+休365*4%的年假(工作日年假)

这个解释不对. 我查询了政府网站, 不是说你放弃休假才能得到Vacation Pay, 而是说你有带薪休假的权利, 即: 当你为老板工作满一年之后, 你有权利在第二年任何时候休两个星期, 同时老板必须支付你Vacation Pay, 钱数是你第一年收入的4%.

你真牛,你打过工吗,拿了4%现金再修4%=2weeks年假

不是我牛, 这是法律规定, BC省政府网站是这样写的: When an employee takes an annual vacation earned in the previous year of employment, the employer must pay vacation pay of at least four per cent of all wages paid to the employee in that previous year.

政府网站还给了一个例子:
  • Robyn starts a new job on March 1, 2008. She completes her first year of work on February 28, 2009 and becomes entitled to take an annual vacation. Her employer must grant Robyn a vacation no later than February 28, 2010.
When Robyn takes a two week vacation in July 2009, her employer pays her 4% of her gross earnings from the period March 1, 2008 – February 28, 2009 for vacation pay. Since Robyn is not working during those two weeks, she does not receive any regular wages. This vacation pay amount becomes part of her gross wages for the year from March 1, 2009 – February 28, 2010.

如果你不放年假,你同样有薪,但区别是你另外得4%年薪,等同于你那些日子干活双薪。

没薪的放假叫停薪留职,那不是正常人的假。

好象你说得对。其实不管休不休假,vacation pay都有的,只不过不休的话同时在挣钱,休的话占用计划内工作时间。

离开BC省快九年了,记得是这样的:
1. 第一年没有Vacation
2. 第二年开始有10天的Paid Vacation. 如果不休假,雇主要另外给Vacation pay。一年240工作日+10天休假,所以相当于4%的工资。或者工作240天拿250天的工资,或者工作250天,拿工资的104%,或者之间的任何组合,往往按照小时计算的。
3. 如果一年没有做满就离职的,雇主需要按照4%支付Vacation pay,因为第一年没有休假。
